Worker Cleans up in Saipan



In Saipan, the operator of a poker room has been ordered to pay over $19,000 to a commercial cleaner forced to work with no days off as a cashier.

Following a hearing, the island’s Department of Labour ruled that Jung-A Enterprises Inc should compensate Melanie Lleno Gonzales $9,623.04 for unpaid overtime wages she accrued over one year. In addition, Jung-A has been ordered to pay Gonzales an equal amount in liquidated damages for a total of $19,246.08 less tax.

Gonzales testified under oath that she was hired in January of 2006 as a commercial cleaner but was utilised as a poker cashier from her first day.

Her contract called for the standard minimum wage of $3.05 per hour with overtime to be paid should she work in excess of 40 hours per week. The hearing found that Jung-A did not pay Gonzales according to the terms of the approved contract but paid a flat $600 per month while requiring her to work a twelve-hour shift seven days a week with no time off.

“The complainant testified under oath on behalf of her claim and appeared entirely credible throughout her testimony,” said Herbert Soll, Administrative Hearing Officer for the Department of Labour.

The Officer also sanctioned Jung-A $3,000 for three violations of the Non-Resident Workers' Act and disqualified the company from employing non-resident workers in the Commonwealth. Officials stated that this prohibition could be modified or removed if the company made substantial compliance with the payment orders.
